INCOTERMS 2010的主要變化
2010年9月27日，國際商會在巴黎召開國際貿(mào)易術語解釋通則2010全球發(fā)布會，正式推出其于近期剛剛完成修訂的Incoterms 2010。這標志著被經(jīng)貿(mào)界使用了近十年的Incoterms即將被新版本所取代。 新版本將于2011年1月1日正式生效。
Incoterms® 2010 與Incoterms 2000的關系：
雖然Incoterms 2010 將于2011年1月1日正式生效，但是Incoterms2010實施之后并非Incoterms 2000就自動作廢。因為國際貿(mào)易慣例本身不是法律，對國際貿(mào)易當事人不產(chǎn)生必然的強制性約束力。國際貿(mào)易慣例在適用的時間效力上并不存在“新法取代舊法”的說法，即2010實施之后并非2000就自動廢止，當事人在訂立貿(mào)易合同時仍然可以選擇適用Incoterms 2000甚至Incoterms 1990。
外貿(mào)人員應該學習掌握Incoterms 2010新的規(guī)則。但是，外貿(mào)人也無須過于擔憂。首先，貿(mào)易一線的人員沒有必要擔憂，未來的兩三年Incoterms 2000仍然會是貿(mào)易合同的主角；法律界的法官、律師們更無須擔憂，Incoterms 2010糾紛兩三年之后才會大量出現(xiàn)。
但是司法考試的同學們明年要特別注意了，因為不出意外的話明年司法考試的大綱會將Incoterms 2010列為司考內(nèi)容。
Incoterms 2010主要變化：
1. 術語分類的調(diào)整:由2原來的EFCD 四組分為適用于兩類：適用于各種運輸方式和水運
2、貿(mào)易術語的數(shù)量由原來的13種變?yōu)?1種。
3、刪除INCOTERMS2000中四個D組貿(mào)易術語，即DDU (Delivered Duty Unpaid)、DAF (Delivered At Frontier)、 DES (Delivered Ex Ship)、 DEQ (Delivered Ex Quay)，只保留了INCOTERMS2000D組中的DDP（ Delivered Duty Paid ）。
4、新增加兩種D組貿(mào)易術語，即DAT （ Delivered At Terminal ）與DAP（Delivered At Place ）。
5、E組、F組、C組的貿(mào)易術語基本沒有變化。
Incoterms2010 are arranged into the two distinct groupsgroups:
Any Mode of Transport
CIP – Carriage and Insurance Paid
CPT – Carriage Paid To
DAP – Delivered At Place
DAT – Delivered At Terminal
DDP – Delivered Duty Paid
EXW – Ex Works
FCA – Free Carrier
Sea and Inland Waterway Transport Only
CFR – Cost and Freight
CIF – Cost, Insurance and Freight
FAS – Free Alongside Ship
FOB – Free On Board
In addition to the 11 rules, Incoterms®2010 will include:
* Extensive guidance notes and illustrative graphics to help users efficiently choose the right rule for each transaction;
* New classification to help choosing the most suitable rule in relation to the mode of transport;
* Advice for the use of electronic procedures;
* Information on security-related clearances for shipments;
* Advice for the use of Incoterms® 2010 in domestic trade
